The Original Kentucky Colonel (title holder) from “Old Kentucky” need their “rights, privileges and responsibilities” restored and recovered from the customs and traditions of Kentucky common-law, they have been diminished by the US District Court since 2020. The Kentucky Colonel™ “title-mark” empowers the colonel with these rights through creating a strong identity that is set-apart from others in similar occupations. Our position is to protect the term as a title which forms part of a person’s name that is awarded by the governor as letters patent, because that is what it is.

Letters patent are formal documents issued by the government that confer a right or privilege on the recipient. The Commission of the Kentucky Colonel is issued under the Governor’s seal and is therefore considered to be a form of letters patent, it is an instrument innotescimus.

In 2021, an Agreed Permanent Injunction was established between the former president of Kentucky Colonels International (defunct) not to use the trademark “KENTUCKY COLONELS” with the letter “S” in his new company name, and to only use the term “Kentucky Colonels” descriptively in a way that does not confuse the public for non-commercial, motivational, educational, genealogical, historical and informative purposes. The new unincorporated publication website and its ownership was called Kentucky Colonelcy [kycolonelcy.us] and it does not credit the Honorable Order of Kentucky Colonels as the legitimate or original source or origin of the Kentucky Colonel.

Col. David J. Wright says the Agreed Permanent Injunction serves as a guideline to protect the HOKC as a charity, it is not a statutory injunction nor was there any evidence of infringement after the case was dismissed, the injunction was not created to restrict the civil rights of Kentucky colonels, but it has been used to create alleged confusion.
