Office of Ombudsman (Malawi)

The office of ombudsman is mandated to investigate acts of maladministration perpetrated by government officials.

Section 123 of the constitution provides that the Ombudsman is mandated to investigate any matters where it is alleged that a person has suffered injustice and it does not appear that there is any remedy reasonably available by way of proceedings in a court or by way of appeal from a court where there is no other practicable remedy. Section 5(1) of the Ombudsman Act law further states that the injustice should have been occasioned by an official of an organ of government. Further to that, Section 5(1) of the Ombudsman Act expounds that the Ombudsman may investigate any alleged instance or matter of   abuse of power or unfair treatment of any person by an official in the employ of any organ of Government, or manifest injustice or conduct by such official which would properly be regarded as oppressive or unfair in an open and democratic society

I am employed by the Office of Ombudsman as a Senior Legal Officer. I have been working for the Ombudsman for four years and prior to that I worked with the Malawi Human rights Commission for two years. My job is to legally advise the Ombudsman on internal and external case that come before our office. I draft determinations and all other pertinent court documents. I conduct mediations and other forms of alternative dispute resolution. I conduct systemic and on spot investigations on cases of alleged injustices and human rights violations. I conduct and mobile legal clinics on cases brought before the office and undertake human rights situation monitoring visits to prisons and places of detention. I also conduct workshops , sensitization meetings on human rights
