In the March 22, 2011 decision, Nubian Minors v. Kenya, the African Committee of Experts on the Rights and Welfare of the Child found Kenya in violation of the African Children’s Rights Charter because of discriminatory rules and practices being applied to Nubian children, denying them recognition of Kenyan nationality and subjecting them to social and material exclusion. Three years later, little has changed. A policy brief based on field reporting by community paralegals has now been submitted to the ACERWC to urge meaningful implementation of the Charter.
